Terms & Conditions

These terms apply to everything you buy from Ernie’s on ernies.je, by phone or in our St John store. Part A covers all purchases and use of the website; Part B adds the rules for offers, sales and promotions.

Part A – General terms

1. About us and these terms

1.1 “Ernie’s”, “we”, “us” and “our” means Ernie Le Feuvres Ltd, a company registered in Jersey under number 102062, trading as Ernie’s, of Cranwell, Rue De Bechet, St John, Jersey, JE3 4FT. Our GST registration number is 0025036. You can contact us on +44 (0) 1534 482 776 or at info@ernies.je.

1.2 “You” means the person using our website or buying from us. A “consumer” is an individual buying wholly or mainly outside their trade, business or profession.

1.3 These terms apply to every order placed on ernies.je, by phone or by email, and to your use of the website. In-store purchases are covered by sections 3, 7, 9 and 10 and, for promotions, Part B.

1.4 Please read these terms before ordering. By placing an order you agree to them. Our Delivery information, Refunds/Returns Policy and Privacy Policy form part of these terms.

1.5 Nothing in these terms affects your statutory rights as a consumer under Jersey law, including the Supply of Goods and Services (Jersey) Law 2009 and the Consumer Protection (Unfair Practices) (Jersey) Law 2018.

2. Using our website and your account

2.1 You may use the website to browse, buy from us and manage your account. You must not misuse it, for example by introducing viruses, trying to gain unauthorised access, scraping content or prices by automated means, or using it for any unlawful purpose.

2.2 We aim to keep the website available but cannot guarantee it will always be uninterrupted or error-free. We may suspend or change it for maintenance or updates.

2.3 If you create an account, keep your password confidential and tell us straight away if you think someone else has used it. You are responsible for orders placed through your account unless they were placed without your permission and not through your carelessness.

2.4 You must be 18 or over to place an order. Some products (for example, sharp tools, chemicals or fuels) may have age restrictions, and we may ask for proof of age on delivery or collection.

2.5 We may close or suspend an account that is used in breach of these terms.

2.6 Links to other websites are for your information only. We are not responsible for their content.

3. Products, prices and GST

3.1 Product information. We describe and picture products as accurately as we can, often using information from manufacturers such as Sealey, Fiskars and JCB. Images are for illustration; colours and packaging may vary slightly. Technical specifications may change when a manufacturer updates a product.

3.2 Stock status. Each product page shows whether an item is “In stock”, “Available to order” (ordered in from our supplier) or “Out of stock”. Stock levels are updated regularly but may not reflect in-store sales in real time.

3.3 Prices include GST. Prices shown to consumers include Jersey GST at the current rate. Delivery charges, if any, are shown at checkout before you pay.

3.4 Online and in-store prices are normally the same, but may differ occasionally, for example during an online-only or in-store-only promotion.

3.5 Price changes. Prices may change at any time, but changes will not affect orders we have already accepted. If GST changes between your order and delivery, we will apply the rate that is legally due.

3.6 Safe use. Many of our products (for example, power tools, compressors, lifting equipment, chemicals and fuels) can be dangerous if misused. Always follow the manufacturer’s instructions and safety warnings.

4. Ordering and the contract

4.1 Placing an order. Your order is an offer to buy. Before you submit it, you can check your basket and correct any input errors.

4.2 Acceptance. We send an automatic acknowledgement when you place an order; this is not acceptance. The contract is formed when we email to confirm that we have accepted your order or dispatched the goods (or, for Click & Collect, confirmed your reservation).

4.3 Items available to order. For items not held in stock, we will give you an estimated delivery or collection date. This depends on our supplier and is not guaranteed. If the supplier can no longer supply the item, we will tell you and refund anything you have paid for it.

4.4 When we may decline an order. We may decline or cancel an order before acceptance, for example if the item is unavailable, we cannot verify payment, or we suspect fraud. If we do, we will refund anything you have paid.

4.5 Pricing and description errors. If a price or description is obviously wrong (for example, a decimal point in the wrong place), we are not obliged to supply at that price, even after acknowledging your order. We will contact you, and you can either buy at the correct price or cancel for a full refund.

4.6 Language and records. Contracts are made in English. We do not file individual contracts, but we email you your order details, so please keep a copy.

5. Payment

5.1 We accept Visa, Mastercard, Maestro, American Express, Google Pay and JCB. Online payments are processed securely by Citypay: we do not store your full card details.

5.2 Payment is taken when you place your order, unless you have a trade account with agreed credit terms (section 8).

5.3 For Click & Collect, you can pay online when you reserve or in store when you collect, as shown at checkout.

5.4 Goods remain ours until we have received full payment. Once they are delivered or collected, they are your responsibility.

6. Delivery and Click & Collect

6.1 Delivery area. We deliver within Jersey only, unless agreed otherwise in writing.

6.2 Delivery charges. Delivery is free on orders over £100 (after any discounts); otherwise a £5.00 charge is added at checkout. Items over 50kg, or deliveries to remote locations, may carry an extra charge. We will tell you about any extra charge before dispatch, and you may cancel if you do not accept it. Full details are on our Delivery page.

6.3 Delivery times. We will give you an estimated delivery date. If we are delayed by events outside our control, we will let you know and keep the delay as short as possible. If delivery is significantly late, consumers may cancel and receive a full refund for undelivered goods.

6.4 Receiving your delivery. Someone should be available to receive the goods, and large or heavy items may need help to unload. Please check your goods when they arrive and tell us promptly about any damage or missing items.

6.5 Click & Collect. Choose Click & Collect at checkout. If items are in stock, we reserve them straight away; if not, we will contact you with a later collection date. Bring your confirmation email and reference number when you collect. We hold reserved items for 7 days after telling you they are ready, after which we may cancel the reservation and refund any payment.

7. Cancelling, returns and your statutory rights

Full details are in our Refunds/Returns Policy. In summary:

7.1 Faulty goods. Goods must be of satisfactory quality, fit for purpose and as described. If they are not, you are entitled to a repair, replacement or refund under your statutory rights. Please tell us as soon as you notice a problem; reporting transit damage within 48 hours of delivery helps us claim from the carrier, but a later report does not remove your statutory rights.

7.2 Change of mind – online and phone orders. Consumers may cancel within 14 days of receiving the goods, without giving a reason. Tell us within that time, then return the goods within a further 14 days, unused and in their original packaging. Unless the goods are faulty or incorrect, you pay the cost of returning them and the original delivery charge is not refunded.

7.3 Change of mind – in store. For in-store purchases, refunds or exchanges for change of mind are at our discretion.

7.4 Special orders. Items made or ordered specifically to your requirements may be non-returnable or carry a cancellation charge in line with our supplier’s terms. We will tell you before you buy if this applies. Standard catalogue items shown as “Available to order” are not special orders for this purpose.

7.5 Condition of returns. Returned goods should include all packaging, manuals and accessories. We may deduct a reasonable amount if goods have been used beyond what is needed to check them.

7.6 Refunds are made to the original payment method within 14 days of us receiving the goods back or proof that you have returned them.

8. Trade accounts

8.1 Businesses can apply for a trade account in store. We may accept or decline any application and may ask for references or a credit check.

8.2 Trade prices and any credit terms are agreed with you individually. Unless agreed otherwise, invoices are payable within 30 days of the invoice date. We may charge interest on overdue amounts at 5% per month and suspend the account until payment is made.

8.3 Trade prices may be shown excluding GST, and will be clearly marked as such. GST is added at the current rate.

8.4 Trade customers buy in the course of business, so the consumer-only rights in these terms (such as the 14-day change-of-mind right in clause 7.2) do not apply. Goods must still be as described and of satisfactory quality, and the implied terms of the Supply of Goods and Services (Jersey) Law 2009 apply as that law allows for business sales.

8.5 For trade customers, our total liability for any order is limited to the price of that order, and we are not liable for loss of profit, business or downtime, except where Jersey law does not allow this limit.

9. Our liability to you

9.1 We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable when the contract was made.

9.2 We supply goods to consumers for domestic and private use. If you are a consumer and use goods for a business purpose, we are not liable for loss of profit, business or business opportunity.

9.3 We are not responsible for loss or damage caused by using a product other than in line with the manufacturer’s instructions, by fair wear and tear, or by alterations or repairs not carried out by us.

9.4 Manufacturer guarantees are in addition to, and do not replace, your statutory rights.

9.5 We are not liable for delays or failures caused by events outside our reasonable control, such as severe weather, shipping or ferry disruption, or supplier failure. We will tell you and do what we reasonably can to limit the effect.

9.6 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Jersey law.

10. Intellectual property, privacy, law and contact

10.1 Intellectual property. The website’s content, design and the Ernie’s name and logo belong to us or our licensors. Brand names and logos (such as Sealey or John Deere) belong to their owners. You may view and print pages for personal use, but not copy or reuse content commercially without our permission.

10.2 Privacy. We use your personal information as described in our Privacy Policy and in line with the Data Protection (Jersey) Law 2018. You can unsubscribe from marketing emails at any time.

10.3 Changes to these terms. We may update these terms from time to time. The version on the website when you place your order applies to that order.

10.4 General. If a court finds any part of these terms invalid, the rest still applies. If we delay enforcing a term, we can still enforce it later. You may not transfer your rights under a contract without our consent.

10.5 Governing law. These terms and any contract are governed by the laws of the Island of Jersey, and the Jersey courts have jurisdiction.

10.6 Questions and complaints. Contact us on +44 (0) 1534 482 776, at info@ernies.je, or in store at Cranwell, Rue De Bechet, St John, JE3 4FT. We aim to respond within [5] working days. If we can’t resolve your concern, you can contact Jersey Trading Standards for advice.

Part B – Offers and sales

11. How the offer terms work

11.1 Part B applies to every offer, sale, promotion and discount advertised by Ernie’s on our website, in store, by email or on social media (each an “Offer”), including those on our Offers page.

11.2 Part A applies to Offer purchases as well. If Part A and Part B conflict, Part B applies to the Offer.

11.3 An individual Offer may carry its own specific terms (for example, the dates of a named promotion). Those apply together with Part B and take priority if they differ.

11.4 Where an Offer is marked “Trade”, it is open only to approved trade account holders.

12. General offer terms

12.1 Offer period. Each Offer runs for the dates shown on it (for example, “Sealey Tool Promotion, October – December”). Where no end date is shown, it runs until we end it under clause 15.4. Online, an order qualifies only if placed within the Offer period (Jersey time).

12.2 Selected lines only. An Offer applies only to the products shown as included, not to every product of that brand or category, unless stated otherwise.

12.3 While stocks last. Offers are subject to availability. An Offer marked “while stocks last” ends early once that stock is sold.

12.4 Items available to order. If you order an Offer item shown as “Available to order” during the Offer period, you pay the Offer price even if it arrives after the Offer ends. Clause 4.3 applies if the supplier cannot supply it.

12.5 Quantity limits. We may limit the number of Offer items per customer, household or order, and will show any limit on the Offer. We may decline orders that appear to be for resale.

12.6 Online and in store. Offers apply both online and in store unless marked “online only” or “in store only”.

12.7 No cash alternative. Offers have no cash value and cannot be exchanged or transferred.

12.8 Combining offers. Unless stated otherwise, Offers cannot be combined with each other, trade discounts, staff discount or price matches. Where more than one Offer could apply, you get the one that saves you the most.

12.9 Earlier purchases. Offers do not apply to items bought before the Offer started.

13. Sale prices and price comparisons

13.1 “Was” and “Original price”. Where we show a product as “Sale!” with an original or “was” price, that is the price at which we genuinely offered it in Jersey immediately before the sale. We do not run a sale price for longer than the product was previously offered at the higher price.

13.2 “Save” and percentage claims. “Save £X” or “X% off” is worked out from the price in clause 13.1. “Up to X% off” means at least some products in the Offer carry the full saving.

13.3 RRP. If we compare with a recommended retail price, we say whether it is a Jersey RRP or a UK RRP, because UK RRPs include UK VAT rather than Jersey GST.

13.4 Supplier promotions. Some Offers, such as the Sealey Tool Promotion, use promotional prices set by the manufacturer for a fixed period. The dates are those set for that promotion and are shown on the Offer.

13.5 Price drops after purchase. If a price falls after you buy, we do not refund the difference unless we have advertised a price promise that says so.

14. Discount codes, multi-buys and free gifts

14.1 Discount codes must be entered at checkout before you place your order. Each code can be used once per customer unless stated otherwise, and may carry a minimum spend (before delivery) or an expiry date. Codes cannot be used on sale items unless the code says so.

14.2 Misuse. Codes are for the person they were issued to. We may cancel a code, or an order using it, if it was obtained or shared in breach of these terms or used in a way that is clearly not intended.

14.3 Multi-buy and bundle offers. All qualifying items must be bought in the same transaction. The cheapest qualifying item is the free or discounted one, unless stated otherwise. If you return part of a multi-buy or bundle, the refund is adjusted so you keep only the discount you are still entitled to.

14.4 Free gifts are subject to availability. If a gift runs out, we may substitute one of similar or higher value, or end the gift offer. If you return the main product, please return the gift unused; otherwise we may deduct its stated value from your refund.

14.5 Gift cards and vouchers can be used on Offer items, subject to their own terms.

15. Returns on offer items and changes to offers

15.1 Same rights as full-price goods. Sale and Offer items are covered by section 7 in the same way as full-price items. Buying in a sale does not reduce your legal rights.

15.2 Reduced because of a defect. Where an item is reduced because of a defect, or sold as ex-display or graded, we will point out the defect at the time of sale. You cannot later return it for that defect, but your rights for any other fault are unaffected.

15.3 Refund amount. Refunds and exchange credit for Offer items are based on the price you actually paid, after any discount, code or multi-buy adjustment (clause 14.3), not the original price.

15.4 Changing or ending an Offer. We may change, extend or end an Offer early for a good reason, such as a supplier ending a promotion, stock running out, a pricing error or suspected misuse. This will not affect orders we have already accepted.
